Virgin Islands overtime is the greatest of daily 8, weekly 40, and the sixth consecutive day

24 V.I.C. § 20 (Justia) pays time and a half for whichever excess is greatest: hours over 8 in a day, hours over 40 in a week, or all hours on the 6th and/or 7th consecutive day. Nine hours, five eights, and no pyramid

Load a 9-hour day at $20: 8 regular + 1 overtime. Load five 8-hour days: 40 regular, 0 overtime. Five 9-hour days are 40 regular + 5 overtime — the five daily-OT hours are already out of the weekly 40, so weekly does not add another five.

§ 20(c) split-interval (not tourist/restaurant)

Whenever an employee is regularly required to work more than one shift in one calendar day and the interval exceeds two hours, the employer pays the regular rate for the excess over two hours. That pay is not hours worked and does not change overtime. Load 7:00–11:00 and 15:00–19:00 at $20: eight hours of wages $160 plus 2 interval hours × $20 = $40. Tourist/restaurant employers are exempt from (c).

§ 20(b) tourist / restaurant 6th-day exception — toggle, default off

Justia 24 V.I.C. § 20(b): a tourist-service or restaurant employer may schedule 6 consecutive days; overtime on the 6th consecutive day is off, and the 7th consecutive day, daily 8, and weekly 40 still apply (greatest of). FAQ

When is overtime owed in the U.S. Virgin Islands?

VIDOL Day 6 (18 April 2026) restates 24 V.I.C. § 20: time and a half for work exceeding 8 hours per day, exceeding 40 hours per week, and work on the 6th or 7th consecutive day. A 9-hour day at $20 is 8 regular plus 1 overtime. Five 8-hour days are all regular.

Does USVI pyramid daily overtime into weekly overtime?

No. Hours already paid as daily overtime (including all hours on a 6th or 7th consecutive day) are excluded from the weekly 40 so the same hour is not paid twice. Five 9-hour days are 40 regular plus 5 overtime, not 40 plus 5 daily plus 5 weekly.

Are all hours on the 6th consecutive day overtime?

Yes under the general rule. VIDOL and the official poster pay time and a half for any hours on the sixth and/or seventh consecutive day. Six 8-hour days are 40 regular plus 8 overtime (the sixth day in full). A zero-hour day breaks the consecutive streak.

What is § 20(c) split-interval pay?

Except tourist/restaurant, if more than one shift falls in one calendar day and the interval exceeds two hours, pay the regular rate for the excess over two hours.
