How 778.202 / § 207(e)(5) pays

The official Cornell LII reprint of 29 CFR 778.202 (HTTP 200), eCFR 778.202 (follow 302→200), Cornell 778.201 (HTTP 200), Cornell 29 U.S.C. § 207 (HTTP 200), the U.S. House uscode prelim text (HTTP 200), and GovInfo USCODE-2023 § 207 (HTTP 200) provide that extra compensation for hours worked in excess of 8 per day or in excess of the § 7(a) weekly maximum — when that extra is contingent on those excess hours and reflected in an agreement or established practice — is excludable from the regular rate under section 7(e)(5) and may be credited toward statutory overtime under section 7(h). 778.202(b) also covers an agreed daily standard other than 8 (for example 7). 778.202(c) credits even a small extra (the $12 / $12.50 example). Unlike 778.203, 1.5× is not required for the exclusion.

Why is this more than FLSA weekly-40 on a 48-hour week?

Daily 1.5× after 8 on three 16-hour days pays extra half-time on 24 hours. Weekly OT is only 8 hours. The extra 16 hours of daily premium stay as true overtime pay under 778.202 / § 207(h).

Is this the same as 778.203 Sunday premium?

No. 778.203 is § 207(e)(6) for Saturday, Sunday, a holiday, or a regular day of rest, and it requires at least 1.5×. This page is hours in excess of a daily or weekly standard under § 207(e)(5).

Waiting-time or meal/rest?

No. This is a § 207(e)(5) overtime-premium credit, not a final-pay penalty and not a missed-break premium.
