California extra player overtime (WO 12 § 3(D))

Motion-picture extra players under IWC Wage Order 12 § 3(D) / 8 CCR § 11120. 1.5× for the 9th and 10th work hours, 2× after 10 (in tenths of an hour), and 1.5× after 40/week with daily premiums credited (no compounding). Not LC 510 after-8-through-12 / DT-after-12. Not general WO 12 § 3(A) crew.

How Wage Order 12 § 3(D) pays

Wage Order 12 covers the motion picture industry. Extra players — background extras, stand-ins, doubles, sports and dress extras, and similar on-camera extras — have a dedicated daily overtime band in § 3(D): from the time the extra is required and does report until dismissed, hours over eight pay one and one-half times for the ninth and tenth work hours and not less than double for all hours thereafter, computed in units of one-tenth (1/10) hours. Weekly overtime is 1.5× after 40, and daily OT payments are applied toward weekly OT so premiums do not compound.

That is not Labor Code § 510. Under LC 510, double time starts only after 12 hours, and hours 8–12 are all at 1.5×. Here double time starts after 10. A twelve-hour day at $20 is $300 on this page and $280 on /california-overtime/.

One 12h day @ $20 → 8 regular + 2 OT + 2 DT = $300 (LC 510 same punches = $280).
One 10h day @ $20 → 8 + 2 OT = $220 (same as LC 510 through hour 10).
One 11h day @ $20 → 8 + 2 OT + 1 DT = $260 (LC 510 = $250).
10h 3m @ $20 → rounds to 10.1h → 8 + 2 OT + 0.1 DT = $224.

Who is an extra player under Wage Order 12?

WO 12 § 2(G) defines an extra player as anyone employed in motion-picture production to perform work including general extra, stand-in, photographic double, sports player, silent bit, or dress extra, and extras employed in dancing, skating, swimming, diving, riding, driving, singing, or other actions/gestures/pantomime. Professional actors are largely exempt under § 1(C).

How does WO 12 § 3(D) daily overtime pay?

Extra players employed over eight hours in a workday from report until dismissed are paid 1.5× for the 9th and 10th work hours and not less than double for all hours thereafter, computed in units of one-tenth (1/10) hours.

How is this different from Labor Code § 510?

LC 510 pays 1.5× for hours after 8 through 12 and 2× only after 12. Extra players switch to 2× after 10, so a 12-hour day at $20 is $300 here versus $280 under LC 510.

Does weekly overtime compound with daily premiums?

No. § 3(D)(3) says overtime payments shall not be compounded and daily OT payments are applied toward any weekly OT due. Five 10-hour days yield 40 regular + 10 daily OT with no extra weekly premium.

Do general motion-picture employees use this calculator?

No. General WO 12 § 3(A) employees follow ordinary 8/12 bands. This page is only the § 3(D) extra-player exception. Use /california-overtime/ for the general California daily/weekly line.
