Alaska flexible work hour plan overtime (after 10 / 40)
DOL-approved voluntary flexible work hour plan under AS 23.10.060(d)(14) / 8 AAC 15.102: 1.5× after 10 in a workday and after 40 in a workweek. Uncheck the plan (deviation week) to revert to after 8 — the same math as /alaska-overtime/. No double time. Not California AWW (election + DT after 12). Not NV public-works 4×10.
How AS 23.10.060(d)(14) / 8 AAC 15.102 pays
When the employer and employee have a written voluntary flexible work hour plan filed with the Department and the Department has issued a certificate stating the work is for 40 hours a week and not more than 10 hours a day, overtime at one and one-half times the regular rate is due for work over 40 hours a week or over 10 hours a day. Hours already paid as daily overtime drop out of the weekly 40 count (anti-pyramiding), the same way standard Alaska overtime excludes hours over 8 from the weekly total.
Participation must be voluntary and cannot be a condition of employment. The Department will not approve a plan for fewer than four days or 33 hours in a week. Except for occasional deviations (not more than 20% of weeks under the plan), a week that departs from the approved schedule is paid under AS 23.10.060(b) — after 8 / after 40. Employees may opt out only from November 1 through December 31 each year (or by mutual agreement to withdraw sooner). CBA flex plans under subsection (d)(13) are a separate track and out of punch scope here.
Four 10h days @ $20 with plan on → $800 (40 regular).
Same punches on /alaska-overtime/ or with plan off → 32 regular + 8 OT = $880.
One 11h day under plan → 10 regular + 1 OT = $230; without plan → 8 + 3 OT = $250.
Five 10h days under plan → 40 regular + 10 weekly OT = $1,100.
One 12h day under plan → 10 regular + 2 OT = $260 (no DT; CA AWW / LC 510 would still have a 2× band after 12).

FAQ
What is an Alaska voluntary flexible work hour plan?
AS 23.10.060(d)(14) and 8 AAC 15.102 let an employer and employee file a voluntary written schedule with the Alaska Department of Labor. When the Department issues a certificate, work under that plan is overtime at 1.5× only after 10 hours in a day or 40 hours in a week — not after 8. The plan must be voluntary, not a condition of employment, at least four days and 33 hours per week, and capped at 10 hours per day / 40 per week before OT.
How is this different from the standard Alaska overtime page?
/alaska-overtime/ always applies AS 23.10.060 after 8 in a workday and after 40 in a week. This page is the (d)(14) flex-plan carve-out: when the DOL-approved plan applies, daily OT moves to after 10. Four 10-hour days are all regular here; on the standard Alaska page the same punches are 32 regular + 8 OT.
Is this the same as a California alternative workweek?
No. California LC 511 uses employee elections, can include 9/80 and healthcare 12s, and still pays double time after 12. Alaska flex plans are DOL-certified voluntary agreements with daily OT after 10 and no double-time band.
What if the employee works a deviation week?
8 AAC 15.102(h) and the DOLWD flex-plan form require AS 23.10.060(b) overtime (after 8 / after 40) when the employee departs from the approved schedule beyond occasional deviations. Uncheck the plan box for a deviation week. The industry notice also lets the employer simply not use the exemption that week.
Does Alaska flex pay double time after 12?
No. Covered overtime under AS 23.10.060 is 1.5× only. There is no 2× band after 12 hours.
Is this Nevada public-works mutual 4×10?
No. /nevada-public-works-overtime/ is NRS 338.020 prevailing-wage OT for construction on public works. This page is Alaska private-sector Wage and Hour Act flex plans under AS 23.10.060(d)(14).
