Minn. Stat. §§ 177.42–177.43 for labor on Minnesota state-funded public works: 1.5× after 8 hours in a day and after 40 hours in a week. Saturday, Sunday, and holidays are not all-hours premiums — unlike Oregon public works (Sat/Sun/holiday all hours at 1.5×) and Missouri public works (Sunday/holiday all hours at 2×). Minn. Stat. § 177.42 subd. 4: "Prevailing hours of labor" means the hours of labor per day and per week worked within the area by a larger number of workers of the same class than are employed within the area for any other number of hours per day and per week. The prevailing hours of labor may not be more than eight hours per day or more than 40 hours per week.

Minn. Stat. § 177.43 subd. 1(1): … no laborer or mechanic employed directly on the project work site … is permitted or required to work more hours than the prevailing hours of labor unless paid for all hours in excess of the prevailing hours at a rate of at least 1-1/2 times the hourly basic rate of pay.

DLI Know Your Rights and MnDOT Labor Compliance: workers required to work in excess of eight hours a day or 40 hours a week shall be compensated at a rate of 1.5 times the basic hourly rate plus fringe benefits (fringe at 1× on every hour). The commercial wage notice states overtime after eight on the project must be paid even if the worker does not exceed forty in the workweek. Enter the hourly basic rate here; fringe cash is labeled, not totaled into the wage ticket. Projects under § 177.43 subd. 7 ($2,500 one-trade / $25,000 multi-trade), off-site delivery of manufactured materials (subd. 2), and highway-heavy § 177.44 classification look-ups are out of scope. Not private-sector Minnesota weekly-48 (§ 177.25) and not Minnesota meal/rest.

FAQ

When is overtime due on a Minnesota public works project?

Minn. Stat. § 177.42 subd. 4 caps prevailing hours at eight per day and forty per week. § 177.43 subd. 1(1) requires at least 1.5× the hourly basic rate for hours in excess of those prevailing hours. DLI and MnDOT: overtime after eight hours a day on the project (even under 40 in the week) and after 40 in a week, at 1.5× basic plus fringe at 1×.

Is Saturday or Sunday time-and-a-half for all hours?

No. Unlike Oregon ORS 279C.540 (Saturday/Sunday/holiday ALL hours at 1.5×) and Missouri RSMo § 290.230 (Sunday/holiday ALL hours at 2×), Minnesota §§ 177.42–177.43 have no weekend or holiday all-hours premium. Saturday and Sunday hours under eight are regular. Eight Sunday hours at $20 basic are $160 here; on /oregon-public-works-overtime/ they are $240; on /missouri-public-works-overtime/ they are $320.

Is this the same as Oregon or Missouri public works overtime?

No. /oregon-public-works-overtime/ pays Sat/Sun/holiday ALL hours at 1.5×. /missouri-public-works-overtime/ pays Sunday/holiday ALL hours at 2× and daily overtime only after 10. Minnesota is after 8 every day with no weekend all-hours premium. A 10-hour weekday @ $20 is $220 here and on Oregon PW without 4×10, but $200 on Missouri PW.

Does the typed rate include fringe benefits?
