Nevada public works overtime (NRS 338.020)

Prevailing-wage overtime on Nevada public works: 1.5× the prevailing rate after 8 hours in a workday (after 10 with a mutual 4×10 agreement) and after 40 hours in a scheduled week. No Saturday/Sunday/holiday all-hours premium — unlike Oregon PW and Missouri PW. Not private NRS 608.018. Not Minnesota PW (no statutory 4×10).

How NRS 338.020 pays

NRS 338.020(3) requires a contractor or subcontractor to pay each mechanic or worker employed on the public work not less than one and one-half times the prevailing rate of wages for each hour worked on the public work in excess of forty hours in any scheduled week of work, or eight hours in any workday — unless by mutual agreement the worker works a scheduled ten hours per day for four calendar days within any scheduled week of work, in which case daily overtime is after ten. Weekly forty converts leftover regular only so the same hour is not paid twice.

There is no statutory Saturday, Sunday, or holiday all-hours premium. Eight Sunday hours at a $20 prevailing rate are $160 here; the same punches are $240 on /oregon-public-works-overtime/ and $320 on /missouri-public-works-overtime/. A ten-hour weekday is eight regular + two overtime ($220) unless the mutual 4×10 box is on ($200 all regular for that day within a four-day 10-hour week).

FAQ

Is Saturday or Sunday time-and-a-half for all hours?

No. Unlike Oregon ORS 279C.540 (Saturday/Sunday/holiday ALL hours at 1.5×) and Missouri RSMo § 290.230 (Sunday/holiday ALL hours at 2×), NRS 338.020 has no weekend or holiday all-hours premium. Saturday and Sunday hours under the daily threshold are regular.

How does the mutual 4×10 agreement work?

NRS 338.020(3)(b): by mutual agreement the mechanic or worker works a scheduled 10 hours per day for 4 calendar days within any scheduled week of work. When that box is on, daily overtime is after 10 instead of after 8 for that week; weekly 40 still applies. Strict adherence matters — contractor guidance warns that deviations can put daily overtime back after 8. CBA subsection 4 schedules that set different OT are out of scope.

Is this the same as private Nevada overtime (NRS 608.018)?

No. /nevada-overtime/ is private-sector NRS 608.018: daily after-8 only when the rate is under $18 (1.5× Nevada minimum wage), otherwise weekly 40 only. This page is public-works NRS 338.020 at 1.5× the prevailing rate after 8/day or 40/week regardless of that private wage tier, with a statutory mutual 4×10 branch. NRS 608.018(3)(n) even carves out hours to which NRS 338.020(3) or (4) apply.

Is this Minnesota or New York Article 9 public-works overtime?

No. /minnesota-public-works-overtime/ and /new-york-building-service-overtime/ also use after-8 / after-40 with no weekend all-hours premium, but Minnesota has no statutory 4×10 daily-after-10 toggle, and NY Article 9 covers building-service employees on the prevailing basic cash rate — not Nevada construction laborers/mechanics on NRS Chapter 338.
