FLSA 778.303 retroactive pay increases — hourly / lump

29 CFR § 778.303 (lump method via § 778.209): a retroactive pay increase raises the regular rate for the period of its retroactivity. Hourly: owed increase×hours + ½×increase×OT hours (CFR: 10¢/h → 15¢ per OT hour). Lump: prorate over hours of the period. How 778.303 pays

Hourly retro. An award of X dollars (or cents) per hour for a past period increases the regular rate by X. Straight-time hours pick up X; each overtime hour picks up X plus an extra half of X — the regulation’s 10¢ → 15¢-per-OT-hour example.

Lump retro. A lump sum for a particular period is prorated back over the hours of that period to find the increase in the regular rate, “in precisely the same manner as a lump sum bonus” (§ 778.209). Additional overtime is one-half of that cents-per-hour increase times overtime hours.

Not 778.120 / not waiting-time / not a separate 778.209 page. 778.120 allocates deferred commissions. This page reopens the rate (or adds a lump) for hours already worked. Percentage / discretionary / gift / profit-sharing bonus pages stay on their own statutes.

Classic · $20 × five 10h + $0.50/h → $1,127.50 (new RR $20.50; extra $102.50; retro add $27.50).

Hourly vs lump?

Hourly applies a flat cents-per-hour increase to every hour (plus half on OT). Lump divides the award by hours in the period first, then applies that increase — the § 778.209 method § 778.303 incorporates by reference.

Same as /flsa-778-120-deferred-commission/?

No. 778.120 allocates deferred commissions across weeks/hours. 778.303 reopens the wage rate (or adds a lump) for a past period.

Why not ship 778.209 itself?

778.209 is the general bonus-inclusion method already referenced by several bonus pages. 778.303 is the commercial formula for retroactive pay increases with the CFR’s 10¢/15¢ example.

Can parties agree to skip the OT premium on the increase?

No. Section 778.303 says the employee is owed the 1.5× increase on overtime hours “no matter what the agreement of the parties may be.”
