§ 17-214(b). A contractor and subcontractor shall pay an employee the prevailing wage rate of overtime for each hour that the employee works: (1) in excess of 10 hours in any single calendar day; (2) in excess of 40 hours per each workweek; or (3) on Sunday or a legal holiday.
MD Labor Prevailing Wage Instructions: Overtime rates shall be paid … which in no event shall be less than time and one-half the prevailing hourly rate of wages for all hours worked in excess of ten (10) hours in any one calendar day; in excess of forty (40) hours per workweek; and work performed on Sundays and legal holidays.
MD Labor Overview: the Prevailing Wage law applies to a construction project valued at $250,000 or more with qualifying State funding. FAQ Q49 example: 12 hours in one day with only 35 in the week still owes 2 hours of overtime; under-10 each day with 42 in the week still owes 2 hours of weekly overtime. Weekly 40 converts leftover regular only — Sunday/holiday 1.5× hours do not pyramid. Legal holidays are those applicable to the public work (check the legal-holiday box; § 17-214 does not enumerate a closed holiday list). Not Maryland agricultural overtime after 60.
