How 34:11-56a4(f) pays

The official NJDOL Wage and Hour Laws reprint (HTTP 200) and N.J.A.C. 12:56-19.3 (HTTP 200, Cornell LII) say every trucking-industry employer shall pay drivers, helpers, loaders, and mechanics for whom the Secretary of Transportation may prescribe maximum hours under 49 U.S.C. § 31502(b) an overtime rate not less than one and one-half times the minimum wage required by N.J.S.A. 34:11-56a4 and N.J.A.C. 12:56-3.1. Those employees are the FLSA § 213(b)(1) Motor Carrier Act set — federal overtime is off.

Formula: hours through 40 × hourly rate + hours over 40 × the greater of the hourly rate or 1.5 × NJ MW. 2026 NJDOL MW is $15.92 (HTTP 200 press, 1 Jan 2026), so the OT floor is $23.88. A $20 driver’s 10 overtime hours add $238.80, not $300. A $30 driver’s overtime hours stay at $30 because $30 already exceeds the floor.

Uncheck trucking for ordinary subsection (b)(1) 1.5× regular rate after 40 (same dollars as /overtime/ on a single hourly). Hotel / farm / motor-bus / limousine / livestock are off under (b)(1) when trucking is also off. This is not /new-jersey-tip-credit/, not /new-jersey-reporting-time/, and not waiting-time.
